1. Introduction
These Terms of Service ("Terms") govern your access to and use of EKKO Review Flow (the "Service"), provided by EKKO Ltd, a company registered in England and Wales (Company No. 16982307), trading as EKKO Loop® and EKKO Sales ("EKKO", "we", "us"). By creating an account or using the Service you agree to these Terms.
2. The Service
EKKO Review Flow helps businesses request customer feedback and direct satisfied customers to public review platforms. You are responsible for the accuracy of customer data you upload and for ensuring you have the right to contact those customers.
3. Accounts
You must provide accurate registration information and keep your credentials secure. You are responsible for all activity that occurs under your account.
4. Acceptable Use
You agree not to use the Service to send unsolicited messages, to incentivise positive reviews in violation of any review platform's policies, or to upload unlawful, harmful, or infringing content.
5. Subscriptions and Payment
Paid plans are billed in advance on a recurring basis. Fees are non-refundable except where required by law. We may change pricing on reasonable notice for future billing periods.
6. Customer Data
You retain ownership of customer data you upload. You grant us a limited licence to process that data solely to provide the Service. Our handling of personal data is described in our Privacy Policy.
7. Termination
You may cancel your subscription at any time from your account settings. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to us or others.
8. Disclaimers and Liability
The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, EKKO's total liability arising out of the Service is limited to the fees you paid in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Governing Law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
